Terms and Conditions

Posting content (including but not limited to: (a) posting any text, photograph, graphics, video and/or audio; and (b) creating your profile) on any Virgin Media website, including but not limited to Your Space (a "Virgin Media Site") will constitute acceptance of these Terms and Conditions and the House Rules. Virgin Media reserves the right, at its sole discretion, to amend the Terms and Conditions and/or the House Rules at any time without notice. Your continued use of any Virgin Media Site after any such amendment constitutes your acceptance of the new Terms and Conditions and/or House Rules. You are responsible for regularly checking the Virgin Media Site to review any changes to the Terms and Conditions and/or House Rules. These Terms and Conditions shall be governed by and construed in accordance with laws of England and Wales.

Your Account

You must provide accurate, current and complete registration information. You are fully responsible for all use of your account and for any acts that may take place using your account.

Submission

Submission for entry to the Programme opens at 6pm (1800) on Monday, 22nd June 2009 and closes at 6pm (1800) on 7th December 2009 at the following website address: http://www.livingtv.co.uk/topmodel

To enter you must be 5’ (foot) 7“(inches) / 170cm (centimetres) or over.

To enter upload a headshot image – in jpg, jpeg, gif or png format (maximum size 1 (one) Megabyte).

Your Conduct

By posting content on any Virgin Media Site for the purposes of submitting your entry to the Programme, you represent, warrant and agree that you are a UK resident and that on 1st January 2010 you will be between the ages of 18 (eighteen) and 23 (twenty three) and that no content (or part thereof) submitted by you or through your account will: (i) breach any law or encourage the commission of an illegal act; (ii) be defamatory, abusive or offensive; (iii) infringe the copyright, moral right, performing rights, rights of privacy, trade mark or other proprietary right of any third party; (iv) constitute a misuse of any confidential information of a third party; (v) contain software viruses or any other computer code, files or programs designed to affect the functionality of any computer software or hardware or telecommunications equipment; or (vi) advertise, promote or endorse any products or services; (c) in respect of images and/or audio-visual content: (i) any individual depicted in the content has consented to the content being posted on the Virgin Media Site; (ii) the content has not been modified or altered in any manner so as to distort or misrepresent any individual or thing depicted in the content; (iii) the content does not contain any personal information such as a name, phone number or e-mail address; and (d) you will not impersonate any person or entity.

Your Content

Virgin Media reserves the right to suspend or delete without notice any content which: (a) it believes in its sole discretion to be detrimental to the enjoyment of any Virgin Media Site by users; (b) breaches these Terms and Conditions and/or the House Rules; or (c) is the subject of a validly served copyright infringement notice.

By posting content on a Virgin Media Site, you grant to Virgin Media a worldwide, non-exclusive, irrevocable, royalty-free, perpetual licence to use and distribute (in whole or in part) such content for any purpose in any and all media (whether now known or hereafter devised) including but not limited to the internet and broadcast television and you hereby waive all so-called moral rights you may have in the content. This licence includes the right to grant sub-licences.

You acknowledge and agree that users of the Site may choose to comment on or vote for the content you submit as entry to the Programme however this is for entertainment purposes only and does not reflect the opinion of Virgin Media, LIVING or the producers of the Programme and by submitting your content you will not necessarily feature in the Programme or take part in auditions for the Programme.

Your Privacy

Each Virgin Media Site is operated in accordance with Virgin Media's privacy policy. Without prejudice to the generality of the Privacy Policy, you acknowledge that we may disclose your content and your identity to third parties where we are required to do so by law.

Your liability for your content and/or conduct

Virgin Media shall not be liable for: (a) any user content posted on any Virgin Media Site; or (b) the conduct of any user of any Virgin Media Site. You agree to indemnify and hold Virgin Media, its group undertakings, and each of their directors, officers, and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable legal fees arising out of or in connection with: (a) any content posted by you or through your account on any Virgin Media Site; (b) your use of any Virgin Media Site; or (c) any breach of these Terms and Conditions and/or the House Rules or of any law or the rights of any third party.

Termination

Virgin Media may terminate your account and/or delete any content (including but not limited to your profile) that you have posted on a Virgin Media Site and/or prohibit you from using or accessing any Virgin Media Site (or any part of the same) for any reason, at its sole discretion, with or without notice.
